These Terms and Conditions (“Terms”) govern your access to and use of the Turf Force Limited website located at www.stihlshopamberley.co.nz (“Website”), and the purchase of products and services from Turf Force Limited trading as STIHL Shop Amberley.

By accessing or using this Website, placing an order, requesting services, or engaging with Turf Force Limited, you agree to be bound by these Terms.

Prices include GST unless otherwise stated.

Delivery charges are additional unless specifically included.

We reserve the right to change pricing without notice.

If a pricing error occurs for any reason, including human or technical error, we reserve the right to cancel the order and refund any payment received.


6. Orders and Payment

6.1 Non-STIHL Products

Products, parts and accessories that are not STIHL branded may be purchased directly through this Website.

Payment is taken at checkout and orders are fulfilled by Turf Force Limited.

6.2 STIHL Products

Certain STIHL products and STIHL product categories may redirect to the official STIHL Shop online platform.

Purchases completed through that platform are subject to the terms and conditions of that platform and STIHL New Zealand.

Turf Force Limited acts as an authorised STIHL retailer and may receive relevant order information for fulfilment and customer service purposes.

6.3 Fraud Prevention

We reserve the right to perform security and verification checks on orders.

Where an order is identified as potentially fraudulent, we may:

  • Request additional information.
  • Delay shipment.
  • Cancel the order.
  • Refund any payment received.

7. Product Availability

We endeavour to fulfil all orders placed through our Website.

Where a product becomes unavailable after an order has been placed:

  • We may offer an alternative product.
  • We may delay shipment until stock becomes available.
  • We may partially fulfil the order.
  • We may cancel the order and provide a refund.

8. Shipping and Delivery

We currently deliver within New Zealand unless otherwise agreed.

Delivery times provided are estimates only and are not guaranteed.

Risk in the goods passes to you upon delivery to the address nominated in your order.

We are not liable for delays caused by:

  • Freight providers.
  • Supply chain disruptions.
  • Weather events.
  • Industrial action.
  • Events beyond our reasonable control.

If a parcel is lost or delayed, we will assist in investigating the issue with the freight provider but cannot guarantee replacement or reimbursement until the investigation is complete.


9. Returns, Refunds and Exchanges

9.1 Your Rights

Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other applicable New Zealand legislation.

9.2 Change of Mind Returns

Subject to the conditions below, we may accept returns or exchanges within 14 days of purchase for:

  • Incorrect size.
  • Incorrect colour.
  • Incorrect product selection.
  • Change of mind.

To be eligible for a return or exchange, the product must:

  • Be unused and in original condition.
  • Be returned with all original packaging, accessories and manuals.
  • Not have been fuelled, operated or damaged after purchase.
  • Be accompanied by proof of purchase.

Acceptance of change of mind returns is at our discretion and may be subject to restocking or freight charges.

9.3 Assembled Equipment

Where equipment has been assembled by STIHL Shop Amberley staff as part of a Click & Collect or pre-delivery service, we will accept the return of assembled equipment provided all other return conditions are met.

9.4 Faulty, Damaged or Incorrect Goods

If a product:

  • Is faulty.
  • Does not meet acceptable quality.
  • Does not match its description.
  • Is supplied incorrectly.

We will meet our obligations under the Consumer Guarantees Act 1993 and any applicable manufacturer warranties.

Depending on the circumstances, we may:

  • Repair the product.
  • Replace the product.
  • Provide a refund.

9.5 Return Process

Products being returned for exchange or refund must be returned to STIHL Shop Amberley at the purchaser’s expense unless the product is faulty, incorrectly supplied or otherwise covered by the Consumer Guarantees Act 1993.

Returns may be made:

  • In person; or
  • Via courier or freight service.

Proof of purchase must accompany all returns.

9.6 Refund Method

Approved refunds will be processed using the same payment method used for the original purchase.

Refunds will not be paid in cash.

Refunds may take several business days to appear depending on your financial institution.

9.7 Shipping Costs

Original shipping and delivery charges are non-refundable unless:

  • The product is faulty.
  • The product does not meet acceptable quality.
  • The product does not match its description.
  • We have supplied the incorrect product.

Where a return is approved under the Consumer Guarantees Act 1993, reasonable return freight costs may also be reimbursed.

9.8 Exclusions

We may decline returns where:

  • The product has been used, damaged or altered after purchase.
  • The product has been misused or operated contrary to manufacturer instructions.
  • The product is a special-order or non-stock item sourced specifically for the customer (unless required by law).
  • The return does not meet the conditions outlined above.

9.9 Manufacturer Warranties

Many products sold by Turf Force Limited are covered by manufacturer warranties in addition to your rights under New Zealand consumer law.

Warranty claims may require inspection, repair assessment or manufacturer approval before a remedy is provided.


10. Workshop Services

Where machinery, equipment or products are provided to us for servicing, repair or inspection:

  • Quotations are estimates only unless expressly stated otherwise.
  • Additional faults discovered during servicing may result in additional charges.
  • Customers will be contacted for approval where practical before additional work is undertaken.

Turf Force Limited is not responsible for delays caused by parts availability, supplier delays or circumstances beyond our control.

Storage of Uncollected Goods

We reserve the right to charge reasonable storage fees for machinery, equipment or goods that remain uncollected for more than 14 days after notification that the work has been completed or the goods are ready for collection.


11. Equipment Hire

Where equipment is hired from Turf Force Limited, separate Hire Terms and Conditions may apply.

Customers are responsible for:

  • Safe operation of the equipment.
  • Following manufacturer instructions.
  • Any loss, theft or damage occurring during the hire period.

Any additional hire agreement will prevail where inconsistencies arise.


12. Trade Accounts

Approved trade account holders may be subject to separate Terms of Trade.

Unless otherwise agreed in writing, trade account invoices are payable by the 20th day of the month following invoice date.

Where separate Terms of Trade apply, those terms prevail over these Terms and Conditions in the event of any inconsistency.


13. Consumer Guarantees Act

Where goods or services are acquired for business purposes, the parties agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by section 43 of that Act.


14. Privacy

We collect, use and store personal information in accordance with our Privacy Policy and the Privacy Act 2020.

By using this Website or purchasing from us, you consent to the collection and use of your information for:

  • Processing orders.
  • Delivering products and services.
  • Warranty administration.
  • Customer support.
  • Marketing communications where consent has been provided.

15. Intellectual Property

All content on this Website, including text, graphics, logos, images, product information and software, remains the property of Turf Force Limited, STIHL, or their respective licensors.

16. Limitation of Liability

  • Loss of data.

Our total liability arising from any claim relating to goods or services supplied by us is limited to the amount paid by you for those goods or services.

Nothing in these Terms excludes rights that cannot be excluded under New Zealand law.


17. Waiver and Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions remain in full force and effect.

Any failure by us to enforce a provision does not constitute a waiver of that provision.


18. Changes to These Terms

We may update these Terms from time to time.

The latest version will always be available on this Website and will take effect from the date published.

Your continued use of the Website constitutes acceptance of any updated Terms.


19. Governing Law

These Terms are governed by the laws of New Zealand.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
